RECOMMENDATION

Staff recommends the City Council approve the final plat of Hunter's Pointe Subdivision. 

EXECUTIVE SUMMARY

The proposed subdivision would create four (4) separate lots intended for multi-family residential development. The property is zoned NX3 – Mixed Residential. Lot 4 is already developed with a newly constructed apartment complex comprised of multiple buildings, demonstrating consistency with the underlying zoning designation. The subject property is generally located south of Central Avenue and west of Brookshire Boulevard, within an area characterized by a mix of residential development and supporting infrastructure.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

On February 12, 2026, Sanbell engineering submitted the final plat for Hunter's Pointe Subdivision. The subdivision creates four (4) lots for residential multi-family housing. The property is zoned NX3-Mixed Residential 3. The property is generally located south of Central Avenue and west of Brookshire Boulevard. Lots 1–3 are currently undeveloped land. Lot 4 has a newly built apartment complex on it. The proposed subdivision received preliminary plat approval on April 26, 2021. The original preliminary plat approval expired on April 26, 2024. An extension was requested and granted by the City Council on February 26, 2024. This extended the expiration date to April 26, 2025. A second extension was requested and granted by the City Council on March 10, 2025. This put the new expiration date to April 26, 2026. See attachments for letters showing extensions. The applicant is now requesting final plat of the subdivision. 

FISCAL EFFECTS

The final plat of this subdivision will have no financial impact on the Planning Division.

STAKEHOLDERS

A public hearing is not scheduled for the City Council meeting; however, nearby property owners may attend the City Council meeting. At this time, the Planning Division has received no public comments or questions regarding the proposed subdivision.

ALTERNATIVES

The City Council may approve or deny the final plat of Hunter's Pointe Subdivision.  If the City Council chooses to deny the final plat, the denial must be because the criteria in Section 76-3-611, MCA are not met.
The criteria are as follows:76-3-611. Review of final plat.
     (1) The governing body or the agent or agency designated by the governing body shall examine each final plat, and the governing body shall approve the plat only if:
          (a) it conforms to the conditions of approval set forth on the preliminary plat and to the terms of this chapter and (local) regulations adopted pursuant to this chapter; and
          (b) the county treasurer has certified that all real property taxes and special assessments assessed and levied on the land to be subdivided have been paid. Staff finds the final plat meets the criteria outlined in 76-3-611 above.

Staff finds the final plat is in compliance with the requirements of state statutes, conditions of approval and local regulations. City Council should approve the final plat.
