RECOMMENDATION

Staff recommends that the City Council approve Change Order No. 8 to the Standard Agreement and General Conditions Between Owner and General Contractor/Construction Manager (Construction Contract) with Dick Anderson Construction, Inc. for the W.O. 19-12: West End Reservoir Project in the amount of $19,379,564.21. 

EXECUTIVE SUMMARY

The West End Reservoir Project is being delivered through a series of phased change orders that allow early procurement and construction activities to maintain the overall project schedule. Change Order No. 8, in the amount of $19,379,564.21, will fund major earthwork including excavation of reservoir bottoms, construction of embankments for two reservoir cells, and associated grading and material hauling. The work was publicly bid with eight bids received, and Martin Construction submitted the lowest bid as a subcontractor to Dick Anderson Construction. Staff recommends approval of Change Order No. 8 to allow earthwork to begin as soon as possible while the project team continues development of the remaining project components.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

On December 11, 2023, City Council approved a Construction Contract with DAC for the West End Reservoir Project in the amount of $153,211.35.  This initial contract Guaranteed Maximum Price (GMP) allowed the Project Team to begin dewatering the reservoir site through rental of temporary pumping equipment and purchase of permanent dewatering equipment.

Change Order No. 1 for the procurement of an electrical equipment substation for the Raw Water Pump Station (RWPS) for a GMP of $408,352.64 was approved by City Council on August 26, 2024.  Early procurement of this equipment ahead of construction was necessary to maintain overall project schedule due to the 40-week lead time in delivering the project site.

On November 25, 2024, City Council approved Change Order No. 2 for the construction of the BBWA Raw Water Delivery (RWD) Facilities for a GMP amount of $13,553,020.76.  Work includes construction of a BBWA Unloader Structure, Screen Structure, Diversion Channel, Raw Water Pump Station (RWPS), a Canyon Creek Diversion Structure, gravel access roads, and 36, 42, and 60-inch connecting piping.

Change Order No. 3 for dewatering pumping improvements for a GMP of $165,070.04 was approved by City Council on December 16, 2024 and allowed for construction of pumping systems that enabled more efficient winter operations and continuous dewatering of the north reservoir site.

On January 27, 2025, City Council approved Change order No. 4 in the amount of $2,168,482.86 to clear a portion of the future north reservoir cell, remove refuse, and install 5,000 linear feet of permanent dewatering drain pipe.  Exploratory excavation located buried concrete and confirmed depth to shale.  Material excavated to install the dewatering pipe was placed in lifts adjacent to the dewatering trench to 10-12 feet above grade for future installation of WEWTP Zone 3 water transmission main.

Change Order No. 5  to install electrical equipment for BBWA RWD Facilities, haul approximately 500,000 cubic yards of material from the City’s north reservoir site to Knife River property, and procure 2 large concrete box culverts and various lengths of FRP pipe for a GMP of $6,102,529.48 was approved by City Council on May 27, 2025.

On July 14, 2025, City Council approved Change Order No. 6 in the amount of $2,011,727.93 to remove a 175’ long section of Hesper Road to a maximum depth of 35’ to install five large diameter utilities (24” to 48”) and 6’ x 5’ and 8’ x 8’ box culverts.  This change order also procured additional 36”, 42”, and 48” FRP pipe, valves, and fittings to enable isolation and independent operation of the north and south reservoir cells.

Change Order No. 7 to clear the City’s South Reservoir site, remove trash, burn slash piles and haul approximately 100,000 cubic yards of material to the Knife River property east of the north reservoir site in the amount of $779,887.57 was approved by City Council on November 10, 2025. The City will have excess material on the south reservoir site, and Knife River would like additional material to spread on their property.

Change Order No. 8 in the amount of $19,379,564.21 now under consideration includes earthwork to construct embankments for two reservoir cells, excavation to remove overburden and shale from each reservoir bottom, filling and grading around each reservoir embankment exterior, and other miscellaneous material hauling.  The project was publicly advertised for 6 weeks between January 16 and February 24, 2026, and 8 bids were received.  Martin Construction submitted the lowest bid and would enter into a subcontract with the General Contractor, Dick Anderson Construction.  Bidding documents included rip-rap armoring/stabilization alternates for the reservoir embankments; however, the bids for these alternates were not cost-effective and are not recommended for award.  The project team is currently evaluating cost-effective options.

It is in the City’s best interest to begin earthwork as soon as possible ahead of evaluating the forthcoming 60% GMP for the remainder of the work (e.g., concrete structures, interior pipelines, cut-off wall). The current project work schedule indicates the West End Water Treatment Plant to be complete in late 2026.

FISCAL EFFECTS

The W.O. 19-12: West End Reservoir Project was budgeted in FY26 using Water Funds.  Considering previously encumbered funds and this change order in the amount of $19,379,564.21, there is approximately $25 million remaining in the budget.

City Council may:
  • Approve Change Order No. 8 to the Standard Agreement and General Conditions Between Owner and General Contractor/Construction Manager (Construction Contract) with Dick Anderson Construction, Inc., or,
  • Not approve Change Order No. 8.  If Council does not approve this change order, the City will not be able to begin construction on the reservoir this spring.
