RECOMMENDATION
Staff recommends that the City Council approve the Annexation Agreement with Larson Family Properties, LLC.
EXECUTIVE SUMMARY
At the April 27, 2026 meeting, City Council will consider annexation of parcels within Certificate of Survey 1100, accompanied by an Annexation Agreement outlining required public improvements. The agreement requires the developer to construct and fund necessary infrastructure, including streets, water, sewer, and storm systems, and includes standard provisions related to the adjacent BBWA Canal and waiver of protest for Special Improvement Districts. The annexation is supported by existing City infrastructure and is not expected to have a significant financial impact on the City. Staff recommends approval of the Annexation Agreement with Larson Family Properties, LLC.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
At the April 27, 2026 City Council meeting, Council will consider the annexation of parcels located within Certificate of Survey 1100. Typically, as a condition of approval of the annexation, the property owner enters into an Annexation Agreement with the City of Billings outlining necessary public improvements. The Annexation Agreement outlines the off-site improvements necessary for development including right-of-way dedications, street access to the site and construction of water, sanitary sewer and storm utilities. As this development is adjacent to the BBWA Canal, the agreement includes a section of warning and indemnification of the City concerning the BBWA Canal. This warning section in the agreement is similar to the language approved by Council for the adjacent property to the north, that is also adjacent to the BBWA Canal.
The Annexation Agreement provides for City-required off-site improvements should the property be annexed and developed without a subdivision plat. Furthermore, the Annexation Agreement contains a waiver of right to protest Special Improvement Districts that does not have an expiration date. At the time of development of each respective Developer parcel, the Developer will be responsible to install at their cost, water, sewer, storm and street services necessary to serve the parcels and to pay the appropriate costs related to traffic study recommendations and City system development fees.

FISCAL EFFECTS
This annexation is served by an existing City street network and utilities. There is no significant financial impact to the City associated with this annexation. Upon development of the annexed parcels, the Developer will be responsible to extend streets and utilities as needed to serve the Developer parcels and to pay associated system development fees and traffic fees identified in their Traffic Impact Study.
STAKEHOLDERS
Stakeholders include the annexation petitioner, adjacent property owners, and the City of Billings.
ALTERNATIVES
City Council may:
- Approve the Annexation Agreement with the Developer; or
- Not approve the Annexation Agreement. If the agreement is not approved, Developer parcels will not be annexed and will not receive City services.
