RECOMMENDATION
Staff recommends that the City Council approve the Annexation Agreement with Donna Barber-Schneider, Diana Browne, and Karin Barber representing Lots 3 and 4, Barber Farm Subdivision.
EXECUTIVE SUMMARY
City Council will consider annexation of parcels within the Barber Farm Subdivision along with an Annexation Agreement outlining standard development requirements. The agreement requires the developer to construct and fund necessary infrastructure, including streets and utilities, as well as pay traffic mitigation costs and system development fees at the time of development, while restricting vehicular access to the Cloverleaf Subdivision. Because the area is already served by existing City infrastructure, no immediate improvements or significant financial impacts are anticipated. Staff recommends approval of the Annexation Agreement for Lots 3 and 4 of the Barber Farm Subdivision.
BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
At the April 27, 2026 meeting, City Council will consider the annexation of parcels within the Barber Farm Subdivision. The proposed Annexation Agreement includes standard provisions requiring off-site improvements upon development and a waiver of protest for Special Improvement Districts. Because the parcels are already served by existing City streets and utilities, no immediate infrastructure improvements or significant financial impacts are anticipated; however, the developer will be responsible for constructing any additional streets and utilities needed to serve future development.
The developer will also be required to fund traffic mitigation measures identified in a traffic study and pay applicable system development fees at the time of development. As part of the agreement, the developer must construct Broadwater Avenue along the project frontage; however, a vehicular connection to the Cloverleaf Subdivision is conditionally prohibited in response to public input and desired traffic patterns.
The developer will also be required to fund traffic mitigation measures identified in a traffic study and pay applicable system development fees at the time of development. FISCAL EFFECTS
This annexation is served by an existing City street network and utilities. There are no significant financial impacts to the City associated with this annexation. Upon development of the annexed parcels, the Developer will be responsible to extend streets and utilities as needed to serve the Developer parcels and to pay associated system development fees and costs to mitigate traffic identified in a Traffic Impact Study.
STAKEHOLDERS
Stakeholders include the annexation petitioner, adjacent property owners, and the City of Billings.
ALTERNATIVES
City Council may:
- Approve the Annexation Agreement with the Developer; or
- Not approve the Annexation Agreement. If the agreement is not approved, Developer parcels will not be annexed and will not receive City services.
