RECOMMENDATION

Staff recommends that the City Council approve the GSA lease amendments to the three federal leases at the Airport.
 

EXECUTIVE SUMMARY

In accordance with a recent Executive Order, the General Services Administration (GSA) is requiring the mandatory addition of a new clause to the three leases it administers at the Airport.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

The U.S. General Services Administration (GSA) is requiring amendments to three (3) federal leases it administers at the Airport for both office and hangar space.  The amendments add an additional federal acquisition regulation (FAR) clause, FAR 52.222-90 to each of the leases to meet the requirements of a new federal Executive Order addressing DEI Discrimination by Federal Contractors.  FAR is the federal government’s primary, overarching set of rules used by federal agencies to govern how they purchase goods and services with federal taxpayer funds to ensure the procurement process is uniform and transparent.  FAR clauses lay out the procedures contractors musts follow when doing business with the federal government. The subject leases pertain to two federal agencies, the Transportation Security Administration (TSA), Lease LMT00188 and LMT15029 and the U.S. Dept of Agriculture Animal and Plant Health Inspection Service (USDA-APHIS), Lease LMT14934.

FISCAL EFFECTS

City Council approved these leases in December 2016 and June 2017.  The approved leases require compliance with all current FAR regulations.  The addition of the FAR 52.222-90 clause will have no financial impact on the existing leases.  Not approving the amendments will result in a financial loss of $340,226.88/year in rental income to the Airport.

STAKEHOLDERS

ALTERNATIVES

The City is required to comply with all current Federal Acquisition Regulations (FAR) in any of its leases with the federal government.  The amendments are mandatory to maintain the leases in good standing.  
  • The City Council may approve the amendments and continue the federal leases, or
  • Not approve the amendments breaching the conditions of each lease and incurring significant financial loss to the airport in lease rents.
