BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)
At its meeting on October 12, 2026, the City Council conducted a public hearing and approved the first reading of the proposed ordinance amendments BMCC 24-441 Purpose; 24-442 Definitions; 24-443 Accessible parking; extent of privileges; prohibited parking; 24-443.1 Requirements for accessible parking spaces; 24-445 Penalty; 24-1004 Parking violation-Procedure generally; 24-1007 Authorization to tow or use vehicle immobilizer; 24-1008 Procedure for vehicle immobilization; and 24-1011 Penalty for violations with a vote of 10-1.

FISCAL EFFECTS
The ordinance amendments establish a $250 penalty for accessible parking violations and increase the unpaid parking citation threshold for vehicle immobilization from $50 to $200. These changes may affect parking citation revenue and the timing of vehicle immobilization activity. However, no significant negative fiscal impact to the Parking Division is anticipated.
STAKEHOLDERS
The ordinance amendments affect persons who use accessible parking, property owners and businesses with accessible parking spaces, and City departments and other agencies responsible for parking enforcement. The amendments provide clearer and more consistent standards for accessible parking and enforcement.
