Staff recommends Council approve the exempt plat, accept the right-of-way, and authorize the Mayor to execute the Quitclaim Deed, thereby transferring Tract 7C of Certificate of Survey 1105 Amended to the public as right-of-way.  

Council is requested to approve an exempt plat and accept a Quitclaim Deed associated with Certificate of Survey 1105 Amended to establish public right-of-way for the extension of Gibbons Avenue to Governors Boulevard. The developers will be responsible for constructing the roadway extension at no cost to the City. Approval of the exempt plat and acceptance of the Quitclaim Deed will have no immediate financial impact on the City.

As part of the development process for Certificate of Survey 1105, the City requested that the developers extend the existing Gibbons Avenue right-of-way, currently platted west of this tract, through the development tract to Governors Boulevard.   Acceptance of the proposed exempt plat and execution of the Quitclaim Deed will create this dedicated public right-of-way.  Additionally, the developers of Certificate of Survey 1105 Amended will construct this portion of Gibbons Avenue at no cost to the City.  Council is requested to approve the exempt plat and accept the Quitclaim Deed at no cost to the City.  

Approval of the exempt plat and acceptance of the Quitclaim Deed will have no immediate financial impact on the City. The developers will be responsible for constructing the Gibbons Avenue extension at no cost to the City.

City Council may:

• Approve the exempt plat and Quitclaim Deed transferring Tract 7C of the proposed Certificate of Survey 1105 Amended to public right-of-way or;
• Disapprove and not accept the exempt plat and Quitclaim Deed.  If not approved, this portion of Gibbons Avenue would not be platted as public right-of-way.
