PROBLEM/ISSUE STATEMENT

North Pointe Square Subdivision, 2nd Filing, is a proposed subdivision that would create five lots on approximately 4.8 acres of land at the northwest corner of U.S. Highway 87 and Main Street in the Heights. The property is currently vacant, but is zoned and proposed for commercial development. City Council granted conditional approval of the preliminary plat of North Pointe Square Subdivision, 2nd Filing, on October 14, 2008. Section 23-302(13) of the City Subdivision Regulations stipulates that the conditional approval of preliminary plats shall be in force for not more than three years, unless a request for an extension is received and approved by City Council.

During the 2011 State legislative session, House Bill 522 amended Section 76-3-610, MCA to allow the governing body to extend the preliminary plat approval period to a "mutually agreed upon period of time." This bill removed the previously established 1-year time limitation for extending preliminary plat approval.  On August 3, 2011, the developer of North Pointe Square Subdivision, 2nd Filing, requested an extension to the preliminary plat approval period for two additional years, in order to coordinate development of required improvements with the adjacent property owners (see attachment). The developer has completed many of the conditions of approval for the final plat and would like to keep the application active. The developer feels starting the preliminary plat period over again would not be beneficial for them or the City.

ALTERNATIVES ANALYZED

The City Council may:
  •  Approve the request to extend the preliminary plat approval for two more years; or
  •  Deny the request to extend the preliminary plat approval for two more years.

FINANCIAL IMPACT

Platting of five lots from a vacant parcel and reselling them to private individuals for commercial development would increase the tax revenues for the City. Allowing the subdivider up to two more years to prepare the final plat documents for approval and recording should not have any direct financial impact to the City.

RECOMMENDATION

Planning staff recommends that the City Council approve the request for an extension of the preliminary plat approval date for North Pointe Square Subdivision, 2nd Filing for two years, and set the new expiration date to October 14, 2013.
