PROBLEM/ISSUE STATEMENT

The final plat for the Amended Lot 9, Holling Ranch Subdivision is being presented to Council for approval. On January 12, 2012, City staff held a pre-application meeting with the applicant to discuss the creation of a two-lot subdivision of 4.3 acres of land. It was determined at that time that the subdivision qualifies for the expedited plat review process, which allows, under certain conditions, subdivisions creating just two lots to proceed straight to final plat review.

The subject property is located on the east side of Main Street, south of Pemberton Lane, in the Heights. It is zoned Highway Commercial (HC). There is a commercial garden center/greenhouse on the proposed western lot, and two single family houses on the proposed east lot. One variance has been requested from Section 23-406(B)(6) of the City Subdivision Regulations. The variance would allow the required right-of-way dedication for Bench Boulevard to be reduced (see Attachment for explanation). The property owner is Randy Miller, and the agent is Scott Bloomenrader, RLS. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Amended Lot 9, Holling Ranch Subdivision. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC, Section 23-305(F).

FINANCIAL IMPACT

Should the City Council approve the final plat, the newly created lots will be taxed separately which may increase tax revenues for the City.

RECOMMENDATION

Staff recommends that the City Council approve the requested variance from Section 23-406(B)(6), BMCC, and approve the final plat of Amended Lot 9, Holling Ranch Subdivision.
