PROBLEM/ISSUE STATEMENT
The new library will be constructed over the alley between North Broadway and North 29th Street, south of 6th Avenue North. It is necessary to vacate the alley in order to construct the Library. All of the utilities have been relocated out of the alley in anticipation of construction. The area of the alley proposed to be vacated is 6,000 square feet.
ALTERNATIVES ANALYZED
The Council may:
- Approve acknowledgment of petition to vacate the above-mentioned right-of-way and set a public hearing for June 25, 2012.
- Do not acknowledge the petition and terminate the right-of-way vacation process. If the right of way vacation process is terminated, the new library will be constructed over public right of way.
FINANCIAL IMPACT
The alley is proposed to be vacated at no cost.
RECOMMENDATION
Staff recommends that Council acknowledge the receipt of petition to vacate the alley within Block 49 of Foster's Addition to the Town of Billings and set a public hearing for June 25, 2012.
