PROBLEM/ISSUE STATEMENT

On July 2, 2012, the Planning Division received an application for preliminary approval for a Subdivision for Rent or Lease (SRL) on Amended Lot 2, Block 4, Cenex Park Subdivision. The subject property is located on the east side of South 25th Street West, just north of Gabel Road. The site plan shows two buildings with multiple warehouse units that may be rented. The subject property is 1.29 acres in size and is zoned Controlled Industrial (CI). The owner is After Shock, LLC and the representing agent is EEC, Inc.

ALTERNATIVES ANALYZED

In accordance with state law, the City Council has 35 working days to act upon this minor SRL; the 35 working day review period for the proposed SRL ends on August 21, 2012. State and City subdivision regulations also require that subdivisions for rent or lease be reviewed using specific criteria, as stated within this report. The City may not unreasonably restrict an owner’s ability to develop land if the subdivider provides evidence that any identified adverse effects can be mitigated. Within the 35 day review period, the City Council is required to:

1. Approve;
2. Conditionally Approve; or
3. Deny the Preliminary Plan

FINANCIAL IMPACT

Should the City Council approve the preliminary plan, the subject property may further develop under private ownership, resulting in additional tax revenues.

General location: East side of S. 25th St. West, between Overland Avenue and Gabel Road.

Parkland requirements: Parkland dedication requirements are not required for industrial subdivisions

STAKEHOLDERS

A public hearing is not scheduled for the City Council meeting; however nearby property owners may attend the City Council meeting. The Planning Division has received no public comments or questions regarding the proposed subdivision.

CONSISTENCY WITH ADOPTED POLICIES OR PLANS

Consistency with the Growth Policy, the Transportation Plan 2009 Update, and Billings Area Bikeway and Trail Master Plan are discussed within the Findings of Fact.
