PROBLEM/ISSUE STATEMENT
Tuscany Subdivision is a proposed subdivision that would create 49 lots on 115 acres of land east of Ironwood Estates and north of Yellowstone Club Estates in northwest Billings. City Council granted conditional approval to the preliminary plat of Tuscany Subdivision on August 11, 2008. Section 23-302(M) of the City Subdivision Regulations stipulates that conditional approval of preliminary plats shall be in effect for not more than three years unless a request for a extension is received and approved by the City Council for a mutually agreed-upon period of time. The City Council may approve more than one extension.
On July 11, 2011, City Council approved a one-year extension of the preliminary plat approval for this subdivision, allowing the owner until August 11, 2012 to obtain final plat approval. The final plat is still not yet ready for approval and the owner of the subject property, Stockman Bank, has requested an additional one-year extension while they continue their plans to develop the property (see Attachment). Approval of this request would extend the preliminary plat approval to August 11, 2013.
