PROBLEM/ISSUE STATEMENT

King Heights LLC, the developer of Kingston Subdivision, is proposing to construct a condominium complex consisting of 24 units on two of the lots within the subdivision.  The units will be constructed in twelve (12) duplex structures with one (1) driveway for each structure.  King Heights LLC is requesting a variance from the curb cut ordinance that limits the number of drive approaches per lot and the size of the drive approaches.  This proposal has been reviewed by the City Engineer's Office and is found to be acceptable due to the fact that the proposed design reduces the number of curb cuts that would be needed to service 24 units if these were individual lots.  The City Council has previously approved variances for similar lots consisting of multiple single family units with multiple drive approaches in other subdivisions.

ALTERNATIVES ANALYZED

The City Council may:

• Approve the variance; or
• Do not approve the variance. If this variance is denied, the owner will have to redesign the project to meet City Code.

FINANCIAL IMPACT

There is no direct financial impact to the City.  Advertising costs for the public hearing are offset by the variance application fee.

RECOMMENDATION

Staff recommends that the City Council approve Variance #CC-12-02 for this property.
