PROBLEM/ISSUE STATEMENT
This is a zone change request from Agriculture Open-Space (A-1) to Controlled Industrial on 2 parcels of land described as C/S 2587, Tract 1 and C/S 3329, Tract 1, a 97.3 acre parcel of land. The property is located northwest of the intersection of Gabel Road and Hesper Road at 3815 Hesper Road. The property is owned by Industrial Planning Associates, LP and Rick Selensky, P.E., of Dowl HKM is the agent. The property is intended for the future development of a FedEx Ground transportation hub on a 50-acre portion of the site. An annexation petition was submitted in coordination with this zone change and approved by Council on March 25. The owner conducted a pre-application neighborhood meeting on December 19, 2012. The Zoning Commission conducted a public hearing on February 5, 2013, and forwarded no recommendation on a 2-2 vote on a motion to recommend approval. The City Council received a valid protest petition against the zone change before the February 25, 2013 public hearing. A valid protest requires a 2/3 majority vote by the present and voting members of the City Council to approve the zone change. The City Council conducted a public hearing on February 25, 2013 and voted to continue the public hearing and delay action on the application until March 25, 2013. Between the February 24 and March 25 meetings, a property owner who had signed the protest withdrew his name and the valid protest was lifted. The City Council approved first reading of the zone change ordinance on March 25, 2013.
ALTERNATIVES ANALYZED
State law at Section 76-2-304, MCA, requires that all zone changes be reviewed in accordance with 10 criteria. Using the 10 criteria to determine the appropriateness of the zone change request, the City Council may:
1. Approve the zone change request;
2. Deny the zone change request;
3. Allow withdrawal of the application;
4. Delay action for up to thirty (30) days.

FINANCIAL IMPACT
If the annexation and zone change are approved, the property will begin paying taxes and fees to the City. If the property is developed, the taxes will increase accordingly. The property will be served by city services. Utilities will be extended to the property and street improvements will be made to accommodate any additional traffic. These costs will be paid for by the developer.
RECOMMENDATION
The Zoning Commission is forwarding no recommendation for the City Council after a 2-2 vote on a motion to recommend approval of Zone Change #907 and adoption of the 10 criteria.
