PROBLEM/ISSUE STATEMENT

J & S Development has developed Grand Peaks Subdivision, 2nd Filing, which is located near 54th Street West and north of Grand Avenue.  All of the storm drain within the subdivision is drained into a retention pond located on Lot 9, Block 1, of Grand Peaks Subdivision, 2nd Filing.  J & S Development is in the process of constructing the pond along with landscaping per City of Billings standards.  J & S Development has agreed to deed this lot to the city, and Public Works will maintain the pond and landscaping as a storm drain facility.

ALTERNATIVES ANALYZED

The Council may:
  • Accept the quitclaim deed from J & S Development, or
  • Do not accept the quitclaim deed. If the deed is not accepted, the public storm drain system will be located on private property.

FINANCIAL IMPACT

There is no significant financial impact for acceptance of this deed.  The annual maintenance costs for the storm drain facility will be paid from the storm drain fund.

RECOMMENDATION

Staff recommends Council accept the quitclaim deed from J & S Development for Lot 9, Block 1, Grand Peaks Subdivision, 2nd Filing.
