PROBLEM/ISSUE STATEMENT
Berry Y & V Fabricators, LLC owns property at 2450 South 32nd Street West. This is located south of Hesper Road and the property and street are in the county. Yellowstone County has vacated South 32nd Street West along the Berry Y & V property boundary, however, the property owner has agreed to grant a utility right of way easement to the City. This easement may be utilized for a future water line to serve properties south of I-90.
ALTERNATIVES ANALYZED
The Council may:
- Accept the Utility Right of Way Easement; or
- Do not accept the Utility Right of Way Easement. In the future, the City would have to find a different route if a water line is to be constructed across I-90 or acquire an easement from the property owner at that time.
FINANCIAL IMPACT
There is no financial impact with acceptance of the easement.
RECOMMENDATION
Staff recommends that Council accept a Utility Right of Way Easement from Berry Y & V.
