PROBLEM/ISSUE STATEMENT
The emergency abatement assessment resolution has been completed by the Finance Department and is ready to be spread on the tax rolls. The following are the three properties which have abatement fees assessed:
3310 1st Avenue South; $10,670.00. Court ordered abatement signed by Judge Kolar on October 25, 2012; complaint originated on February 7, 2012. Violation of Public Nuisance – Dangerous Structure. The small dwelling was damaged by fire and asbestos was spread throughout the building and on to the ground around the building. Abatement required testing for asbestos contamination and abatement was completed by a certified asbestos abatement contractor. Abatement occurred on March 27 and 28, 2013.
417 and 423 Miles Avenue; $1,212.69 and $1,212.70. Court ordered abatement signed by Judge Kolar on February 8, 2013; complaint originated on November 9, 2011. Violations of Open Storage of Junk and Debris and Open Storage of Junk Vehicles. Abatement included removal of 5 junk vehicles, and removal and disposal of three 10-yard dumpster loads of debris to the City landfill. Abatement occurred on April 11, 2013.
Emergency Abatement - Pursuant to BMCC 18-306, Whenever a public nuisance exists which constitutes an emergency presenting imminent danger of serious injury to persons or property. Nonpayment of fees associated with the emergency abatement shall constitute a lien on the non-complying real property and will be taxed as a special assessment against the real property.

ALTERNATIVES ANALYZED
The Council must hold a public hearing and then may:
- Approve the resolution; or
- Not approve the resolution, in which case the property owners will not be assessed, and the General Fund will be responsible for paying for the abatement.
FINANCIAL IMPACT
The assessments total $13,095.39 and the payments will reimburse the General Fund.
RECOMMENDATION
Staff recommends that the City Council conduct a public hearing and approve the attached assessment resolution.
