PROBLEM/ISSUE STATEMENT
On August 12, 2013, City Council approved the sale of Tract 2, C/S 3426 located at 2229 Blue Creek Road to Shawn and Jill Egan for their offer of $250,000. Sale of the property is contingent on development of an acceptable sales agreement and execution of a Perpetual Right-of-Way Easement for the existing and proposed sanitary sewer mains located within the property.
As shown on the attached property plat, the sewer easements have been in place since they were recorded with the plat in 2010. With the transfer of property ownership, City staff believes it is important to execute and record the attached separate easement document with clearly described provisions and Grantor/Grantee rights.

ALTERNATIVES ANALYZED
The Council may:
- Approve the Perpetual Right-of-Way Easement for C/S 3426, Tract 2; or
- Do not approve the Perpetual Right-of-Way Easement. If the easement is not approved, the City's rights with respect to future construction, maintenance, operation, repair or replacement of existing and future critical sanitary sewer mains will not be clearly stated and legally recorded.
FINANCIAL IMPACT
No compensation is associated with the easements.
RECOMMENDATION
Staff recommends that Council approve the Perpetual Right-of-Way Easement document between the Egans and the City on Tract 2, C/S 3426.
