PROBLEM/ISSUE STATEMENT
LAIS Development, Inc. and Buscher Development are proposing to vacate a 5-foot strip of right-of-way on Rimrock Road. With the subdivision plat for Whisper Ridge, the 5 feet was dedicated for Rimrock Road. This 5 feet of right-of-way is not needed for the construction of Rimrock Road in the future because there is a 110 feet of right-of-way, which will be sufficient for an arterial section. Whisper Ridge is located on the north side of Rimrock Road, west of Clearview Drive.
ALTERNATIVES ANALYZED
The Council may:
- After a public hearing, vacate the above mentioned right-of-way; or
- Do not vacate the above mentioned right-of-way.
FINANCIAL IMPACT
Since the right-of-way proposed to be vacated will revert to the original developer and no streets are constructed, there is no cost for the vacation.
RECOMMENDATION
Staff recommends that the City Council approve the vacation of a portion of right-of-way on Rimrock Road.
