Public Hearing and Resolution Authorizing Exchange of Parkland in Copper Ridge Subdivision, 5th Filing

PROBLEM/ISSUE STATEMENT

In 2007 Copper Ridge Subdivision was approved by Council.  With that approval, all of the developer's parkland dedication requirement was deeded to the City. The subdivider is now working to develop Copper Ridge, 5th Filing.  Due to the developers' desire to redesign the configuration of the 5th Filing, the City has now determined that it is in the best interests of the public for the City to convey these dedicated parklands to the developer in exchange for land in the 5th Filing of Copper Ridge Subdivision.  The parkland to be conveyed to the developer is illustrated in Attachment A.  The parkland to be dedicated to the City (see Attachment B) within the 5th Filing will be in excess of the original platted parkland and will be of a configuration more easily used for parkland and recreational purposes by current and future residents.  Attachment C contains the quit claim deed to the property. PRPL recommends the City exchange these previously dedicated parkland parcels as described in the attached Quit Claim Deed for parkland to be dedicated to the City through the platting of Copper Ridge, 5th Filing.

Notice of the Public hearing was published in the Billings Times. and property owners within 300' of the subject parkland were notified of the Public Hearing scheduled for January 27, 2014. At the February 10, 2014, City Council will be asked to approve a street vacation request imperative to Cooper Ridge Subdivision, 5th Filing, and approve the final plat of Copper Ridge Subdivision, 5th Filing. Because the  approval of the vacation request must come first, followed by the parkkland exchange approval, and followed by the final plat approval, staff is recommending that City Council hold the public hearing on the land exchange and move to delay action until February 10, 2014.

ALTERNATIVES ANALYZED

Council must open the advertised public hearing and postpone action until February 10, 2014, in order to not jeapordize the replatting of the fifth filing of Copper Ridge Subdivision.

FINANCIAL IMPACT

There will be no financial impact to the City. 

RECOMMENDATION

Staff recommends that the City Council conduct the advertised public hearing and delay action until the February 10, 2014.
