PROBLEM/ISSUE STATEMENT

Popelka Commerce Center Subdivision, 2nd Filing, located on the north side of King Avenue East and west of South Billings Boulevard, was platted and recorded in August 2014. The Subdivision Improvements Agreement (SIA) recorded with the plat has several places where the wrong lot was referenced when describing a location on the plat. These incorrect references cause confusion when reading the SIA and referencing the plat because the two do not match. 

The applicant has submitted the corrected sections of the SIA. The modifications are attached to this staff report, and shown as underlined and crossed out text of the appropriate SIA sections.

The City Subdivision Regulations, Section 23-1103, BMCC, describes the procedure for amending recorded SIAs and other supporting plat documents.  It indicates that after a request to amend a document is received and reviewed by affected agencies, the Planning Division shall submit a recommendation to the City Council. The City Council may approve the request if it does not significantly alter the original approval and does not conflict with the review criteria set forth in these regulations.

ALTERNATIVES ANALYZED

City Council may:
  • Approve the request to amend the SIA for Popelka Commerce Center Subdivision, 2nd Filing; or
  • Deny the request to amend the SIA for Popelka Commerce Center Subdivision 2nd Filing.

FINANCIAL IMPACT

Approval of the amendment to the SIA would not have a financial impact to the City.
 

RECOMMENDATION

Staff recommends that City Council approve the amendment to the Subdivision Improvements Agreement for Popleka Commerce Center Subdivision, 2nd Filing.
