PROBLEM/ISSUE STATEMENT
There is a City of Billings Slope Easement along Lot 21-A-2, Block 39, Lake Hills Subdivision 12th Filing. Clint Kegal, the owner of the lot, has petitioned that the slope easement be removed. When a street is constructed, it may be at a higher or lower elevation than the fronting property, and the landscaping is typically sloped back from the street to match existing grade. It appears this slope easement may have been put in place in order to extend Constellation Drive north of Riveroaks Drive. However, Constellation Drive will not go further than Riveroaks Drive due to the fact that there is no right of way and the area is fully developed. The property owner requested that the slope easement be vacated.
ALTERNATIVES ANALYZED
The Council may:
- After holding a public hearing, approve the vacation of the slope easement; or
- Do not approve the vacation and the easement will remain in place.
FINANCIAL IMPACT
There is no financial impact to the City to vacate the slope easement. Because this is an easement and not right of way, there would be no cost to the petitioner for the vacated area.
RECOMMENDATION
Staff recommends that the City Council conduct the advertised public hearing and approve the vacation of a slope easement along Lot 21-A-2, Block 39, Lake Hills Subdivision 12th Filing.
