PROBLEM/ISSUE STATEMENT
W.O. 04-12 will relocate Alkali Creek to the north, reconstruct the north slopes, construct wider shoulders along the Alkali Creek Roadway, and resurface Alkali Creek Road between the BBWA siphon crossing and near Aronson Avenue. To complete these tasks, it is necessary to purchase easements from the Morningside Homeowners Association (MHOA) within their common area along Alkali Creek Road. MHOA has agreed to the Easement Agreement as attached. The City Council delayed action on February 22 because the documents had not been signed yet by the MHOA.
ALTERNATIVES ANALYZED
The Council may:
• Approve the easement with Morningside Homeowner’s Association; or,
• Not approve the easement with Morningside Homeowner’s Association.
• Approve the easement with Morningside Homeowner’s Association; or,
• Not approve the easement with Morningside Homeowner’s Association.
FINANCIAL IMPACT
An appraisal of the needed "Real Property" was performed and established the fair and marketable value of the land as $121,410.00. By City Ordinance, we are allowed to offer up to 5% above this value. Therefore, the City will pay MHOA $127,480.50 for the required easements. Also, the Easement Agreement guarantees that the costs incurred by MHOA for their improvements (curb & gutter, sidewalk/path, pavement widening, etc.) will not exceed $75,000, excluding any bond costs or administrative fees associated with financing the improvments. The estimate for that work is under $75,000 so there is no real financial impact associated with that condition.
RECOMMENDATION
Staff recommends that Council approve and authorize the Mayor to execute the Easement Agreement with Morningside Homeowner's Association.
