PROBLEM/ISSUE STATEMENT
An easement is needed from Phillips 66 to construct the improvements for the Yegen Drain project. The project will mitigate current flooding issues by increasing the capacity of the existing drain by straightening the channel, cleaning out sediment deposits, and removing bushes and trees.
ALTERNATIVES ANALYZED
City Council may:
- Approve the easement from Phillips 66 to the City or;
- Disapprove the easement. If the easement is not approved, then there will not be sufficient room to construct the improvements to the Yegen Drain and flooding of the area will continue to occur.
FINANCIAL IMPACT
The City typically pays for easements in an amount usually determined by the value of the land. In this case, Phillips 66 is requesting an easement from the City which would have a similar monetary value. Staff proposes that the easements be granted to each party without costs as an exchange versus a purchase.
RECOMMENDATION
Staff recommends that Council approve the easement from Phillips 66.
