PROBLEM/ISSUE STATEMENT
The annual Burn the Point event includes a street dance on Friday, September 4, 2015. BMCC Chapter 17 limits the amount of noise that any activity may create, with lower limits after 8:00 p.m. The Code allows staff to issue noise waivers for special events or circumstances. The event organizer applied for a noise waiver under BMCC 17-106, requesting a 12:30 a.m. (9/5/15) event stop time. Staff approved a stop time of 11:00 p.m., which is the usual downtown, weekend time limit that was established in consideration of the downtown hotels and residents. The event organizer is appealing the staff determination to the City Council and is requesting a 12:30 a.m. street dance end time.
ALTERNATIVES ANALYZED
City Council may:
- Approve the waiver request, or;
- Disapprove the request.

There are no financial impacts from this action
RECOMMENDATION
Staff recommends that the City Council approve a noise waiver for the Burn the Point street dance with an event end time of 12:30 a.m. on September 5, 2015.
