INTRODUCTION
On October 1, 2015, Performance Engineering and Consulting, agent for Diamond B Companies, applied for preliminary subsequent minor plat approval for Amended Lots 1 and 4, Block 1, Bottrell Subdivision. The proposed plat creates 5 lots from the existing lots 1 and 4 of Bottrell Subdivision. The subject property is about 14 acres in size and is generally located on the north side of Trade Center Avenue and east of Shackelford Lane. The property is zoned Controlled Industrial (CI) and there are existing commercial/industrial uses on the land and in the immediate vicinity. The Board of County Commissioners is scheduled to act on the proposal on December 8, 2015.

- A pre-application meeting was held on August 27, 2015, to discuss the proposal.
- The preliminary plat application was submitted to the Planning Division on October 1, 2015.
- A departmental review meeting was conducted on October 15, 2015.
- The preliminary plat was resubmitted with revisions based on department reviews on October 22, 2015.
- The Planning Board reviewed the plat on November 10, 2015.
- The Planning Board will conduct a public hearing on November 24, 2015, and forward a recommendation to the Board of County Commissioners.
- The Board of County Commission is scheduled to consider the preliminary plat on December 8, 2015.
- The 60 working-day preliminary plat review period ends December 28, 2015.
RECOMMENDATION
Staff recommends that the Planning Board recommend that the Yellowstone County Board of County Commissioners conditionally approve the preliminary plat of Amended Lots 1 and 4, Block 1, Bottrell Subdivision, and adopt the Findings of Fact as presented in the staff report.

- To ensure that public health and safety measures with fire suppression are met , prior to final plat approval the the applicant will receive approval from the Billings Fire Department for the location and accessibility of the proposed dry hydrant.
- To ensure that public health and safety measures with fire suppression are met, the applicant will include with the final plat public easement documents to be recorded with the final plat for the dry-hydrant system.
- To ensure future maintenance of the dry-hydrant system, prior to final plat approval the applicant will create an RSID-M to maintain the dry-hydrant fire suppression system.
- To minimize the effects on the natural environment, prior to final plat approval a weed management plan and property inspection shall be approved and completed by the County Weed Department.
- Minor changes may be made in the SIA and final documents, as requested by the Planning and/or Public Works Departments to clarify the documents and bring them into the standard acceptable format.
- The final plat shall comply with all requirements of the County Subdivision Regulations, rules, regulations, policies, and resolutions of the Yellowstone County, and the laws and Administrative Rules of the State of Montana.

DISCUSSION/STAKEHOLDERS
A brief presentation was provided by staff on the proposed subdivision and then Planning Board President Dick Clark opened the meeting for discussion. A board member asked about the ‘Marathon Loop’ trail that is identified along Trade Center Avenue in the 2014 Zoo Montana to Riverfront Park Trail Feasibility Study, where it will be located along the road right-of-way, and whether the developer is responsible for any of those costs. Staff responded that the trail is identified on the south side of the street and that there is an 80 foot right-of-way so there is plenty of room for the trail. The trail is expected to be located south of the ditch on the south edge of the Trade Center Avenue right-of-way. Staff also explained that there is no requirement of the developer to fund this trail segment in the road right-of-way and there is no identified funding source at this time for the trail in this area.
