PROBLEM/ISSUE STATEMENT

A nuisance abatement assessment resolution has been completed by the Finance Department and the assessment is ready to be spread on the tax rolls. Judge Kolar ordered abatement at 1413 18th Street West on July 8, 2015, based on a complaint from February.  Violations included open storage of junk & debris and off-street parking of inoperable vehicles.  The abatement removed garbage, trash and debris and the County Junk Vehicle Division removed two vehicles from the property.  The City paid the Labor Ready charges and Solid Waste disposal fees.  The property owner was sent a $361.44 bill to recover the cleanup costs and had 30 days to pay it.  The owner did not pay and the City Code requires that the costs be recovered by an assessment that is included on the tax bill.  The abatement occurred in late summer and could not be included in the fall 2015 assessments.
 

ALTERNATIVES ANALYZED

The Council must hold a public hearing and then may:
  • Approve the resolution; or
  • Not approve the resolution, in which case the property owners will not be assessed, and the General Fund will be responsible for paying for the abatement.

FINANCIAL IMPACT

The assessment totals $361.44 and the payment will reimburse the General Fund.

RECOMMENDATION

Staff recommends that the City Council conduct a public hearing and pass the attached assessment resolution.
