PROBLEM/ISSUE STATEMENT
Work Order 09-15 Grand Avenue will widen Grand Avenue from Zimmerman Trail to Shiloh Road. The City Engineer's office has been negotiating with the adjacent owners for the necessary right-of-way. The needed right-of-way was identified on the design project plans and must be acquired prior to construction. Yegen Grand Avenue Farms owns the property south of Grand Avenue from Zimmerman Trail to Shiloh Road. The company has agreed to donate the necessary right-of-way in exchange for the improvements being installed along their Grand Avenue frontage.
ALTERNATIVES ANALYZED
City Council may:
- Approve the right-of-way Agreement and warranty deeds with Yegen Grand Avenue Farms, or;
- Disapprove the right-of-way agreement and warranty deeds. If not approved, there will not be enough right-of-way to widen Grand Avenue.
FINANCIAL IMPACT
Yegen Grand Avenue Farms is donating the right of way and construction easement. In exchange for the right of way, the project will construct all of the Grand Avenue improvements including extending water, sanitary sewer, and storm drain services for future use.
RECOMMENDATION
Staff recommends that Council approve the right-of-way agreement and warranty deeds with Yegen Grand Avenue Farms.
