PROBLEM/ISSUE STATEMENT
Work Order 09-15 Grand Avenue will widen Grand Avenue from Zimmerman Trail to Shiloh Road. The City Engineer's office has been negotiating with the adjacent owners for the necessary right-of-way. The needed right-of-way was identified on the project design plans and must be acquired prior to construction. KZ Bar Limited Partnership owns the property north of Grand Avenue from Zimmerman Trail to the cemetery. The company has agreed to donate the necessary right-of-way in exchange for the improvements along Grand Avenue being installed.
ALTERNATIVES ANALYZED
↵City Council may:
- Approve the right-of-way Agreement and warranty deed with KZ Bar Limited Partnership, or;
- Disapprove the right-of-way agreement and warranty deed. If not approved, there will not be enough right-of-way to widen Grand Avenue.
FINANCIAL IMPACT
KZ Bar Limited Partnership is donating the right of way and construction easement. In exchange for the right of way, the project will construct all of the Grand Avenue improvements including extending water, sanitary sewer, and storm drain services for future use.
RECOMMENDATION
Staff recommends that Council approve the right-of-way agreement and warranty deed with KZ Bar Limited Partnership.
