Pemberton Subdivision, Amended Lot 22A - Preliminary Subsequent Minor Plat

PROBLEM/ISSUE STATEMENT

On June 1, 2016, Pinpoint Land Survey, PLLC, agent for Melodee Haagenson, et al, applied for preliminary Subsequent Minor plat approval for Pemberton Subdivision, Amended Lot 22A. The proposed subdivision creates 3 lots from one residential lot defined as North Lakeview Twin Homes condominium development. The subject property is generally located on North Lakeview Drive, east of Lake Elmo Drive and just east of Lake Elmo.  The property is zoned Residential 6000 (R-60).  There are two existing duplexes on the western end of the parcel, the new lot created by this subdivision will be to the east for new residential construction.  
 

ALTERNATIVES ANALYZED

In accordance with state law, the City Council has 35 working days to act upon this subsequent minor preliminary plat. The 35 working day review period for the proposed plat ends on July 21, 2016. State and City subdivision regulations also require that preliminary plats be reviewed using specific criteria, as stated within this report. The City may not unreasonably restrict an owner's ability to develop land if the subdivider provides evidence that any identified adverse effects can be mitigated. Within the 60 working day review period, the City Council is required to:
1. Approve;
2. Conditionally Approve; or
3. Deny the Preliminary Plat

FINANCIAL IMPACT

If the City Council approves the preliminary plat, the subject property may further develop under private ownership, resulting in additional tax revenues.

STAKEHOLDERS

There is no public hearing in front of the Yellowstone County Board of Planning for minor subdivisions and property owners adjacent to the subdivision are not noticed as per the regulations. However, interested parties may attend the City Council meeting and comment on the subdivision. The Planning Division has not received any comment on the plat at the time this memo was prepared.

CONSISTENCY WITH ADOPTED POLICIES OR PLANS

Consistency with the 2008 Growth Policy, the Transportation Plan 2014 Update, and Billings Area Bikeways and Trail Master Plan are discussed within the Findings of Fact.
