On Feb. 8, 2010, the City Council created an Ad-Hoc Advisory Committee on Medical Marijuana to advise the Mayor and City Council on how to deal with issues raised by the City Council in relation to the drug.  At the recommendation of the Ad-Hoc Committee, the City Council on May 10, 2010, approved a 6-month moratorium on the opening of any new businesses attempting to grow, sell or distribute medical marijuana or paraphernalia within the City limits.  At the same meeting, the City Council created two initiatives.  One was to add 2 at-large members to the Ad-Hoc Committee.  The other was to make recommendations to the staff for options for regulating caregivers.  The attached resolution amends Resolution No. 10-18911, which originally created the Ad-Hoc Committee, to comply with the Council initiatives.

The Council may:

• Approve the resolution amending Resolution No. 18911 by adding two at-large members and asking the Ad-Hoc Committee to make recommendations to staff of options for regulating caregivers;
• Not approve the resolution, keeping the membership at eight and failing to provide information on regulation caregivers; or
• Postpone action on the resolution.

There is no expected financial impact from amending the resolution.

Staff recommends amending Resolution No. 10-18911 as suggested in the Council initiatives.
