PROBLEM/ISSUE STATEMENT
The annual Burn the Point event includes a street dance on Friday, September 1, 2017. BMCC Chapter 17 limits the amount of noise that any activity may create, with lower limits after 8:00 p.m. The Code allows staff to issue noise waivers for special events or circumstances. The event organizer applied for a noise waiver under BMCC 17-106, requesting a 12:30 a.m. (9/5/15) event stop time. Staff approved a stop time of 11:00 p.m., which is the usual downtown, weekend time limit that was established by the special events committee in consideration of the downtown hotels and residents. Events requesting a noise waiver beyond that time must appeal to City Council. The event organizer is requesting a 12:30 a.m. street dance end time. Because this is an annual event, staff requests that the approval or denial of the request be for a period of two years. This event has been an annual event for several years and has not received an inordinate number of noise complaints so staff is recommending approval.

City Council may:
- Approve the waiver request, or;
- Disapprove the request.

RECOMMENDATION
Staff recommends that the City Council approve a noise waiver for the Burn the Point street dance with an event end time of 12:30 a.m. on September 2, 2017 and for the 2018 event.
