PROBLEM/ISSUE STATEMENT
The City of Billings and Kadrmas, Lee & Jackson, Inc. (KLJ) agreed to a Professional Services Contract on April 26, 2004, to cover the design of reconstruction of Alkali Creek Road between Senators Blvd. and Airport Road. Subsequent amendments were passed to encompass different phases of the project (W.O. 04-12). Staff is recommending an amendment to the original contract to cover services related to extended path design, additional construction administration and inspection, relocation of an existing sanitary sewer line, and additional cultural services. The current project scope includes the maintenance of Alkali Creek Road, relocation of the Alkali Creek stream channel, corresponding slope work required due to existing slope stability problems, construction of a multi-use path, and all appurtenant work from Black Pine Street to a point approximately 1,800 feet to the east (between Morningside Lane and Aronson Avenue).
It is proposed to extend the multi-use path approximately 120 feet from the project's east terminus to the west edge of Sword's Park. Additional design services are needed for this extension. A change order will be negotiated with the general contractor to construct the path extension, and additional construction administration and inspection will be needed from KLJ. A City Parks project will ultimately extend the path through Swords Park and tie it into the existing path adjacent to Aronson Ave.
There is an existing 24-inch sanitary sewer line going through the construction area in Morningside Homes. With the newly constructed slope north of the new stream channel, it has been determined that one of the manholes cannot be safely or adequately accessed for routine maintenance. Amendment 10 provides survey, engineering design, plan preparations, and DEQ permit submittal related to installing three new manholes and relocating approximately 170 feet of the sewer line. Geotechnical services will be included to provide excavation, backfill, pipe material, and dewatering recommendations, as well as a precondition survey of structures on the two lots adjacent to the sanitary sewer realignment.
Amendment 8 provided services for the required cultural survey and it acknowledged that additonal costs would be incurred for the final mitigation. The extent of these costs (for lab analysis and report creation and submission) are now known and included in Amendment 10.
More specific details of the services provided by Amendment 10 can be found in the attached scope of work.

ALTERNATIVES ANALYZED
The Council may:
- Approve Amendment No. 10 to the Professional Services Agreement with Kadrmas, Lee & Jackson for services related to additional design, construction administration, inspection, and cultural mitigation reporting; or
- Do not approve Amendment No. 10 to the Professional Services Agreement.
FINANCIAL IMPACT
The project is being funded by ARRA (American Recovery and Reinvestment Act) funds and Arterial fees. Amendment No. 10 represents an increase in the amount of the contract by $59,300.00. The FY 2010 budget has the following amounts:

RECOMMENDATION
Staff recommends that Council authorize the Mayor to execute Amendment No. 10 to the Professional Services Contract with Kadrmas, Lee & Jackson, Inc., in the amount of $59,300.00.
