PROBLEM/ISSUE STATEMENT

The final plat for Hogan Homestead Subdivision, Amended Lot 4-A, Block 5, is being presented to Council for approval. On March 22, 2010, the City Council conditionally approved 2 lots on approximately 9.0 acres of land for commercial development. The subdivision is zoned Highway Commercial (HC) and is located on the southeast corner of the intersection of King Avenue West and South 24th Street West. The plat amendment creates a new .77 acre lot in the northwest corner of the property that contains Shopko. The owner is Spirit Spe Portfolio 2006-1, LLC, and the subdivider is Depierro Realty Advisors. The representing agent is Sanderson Stewart.

The Planning Division and other applicable City Departments have reviewed this final plat and find that the plat and supporting documents conform to the conditions of preliminary plat approval and comply with MCA 76-3-611 and BMCC Section 23-307. Upon City Council approval, the plat and supporting documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Hogan Homestead Subdivision, Amended Lot 4-A, Block 5. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-307.

FINANCIAL IMPACT

Should the City Council approve the final plat, an additional restaurant business is expected to be built on the property and may result in increased tax revenues for the City.

RECOMMENDATION

Staff recommends that the City Council approve the final plat of Hogan Homestead Subdivision, Amended Lot 4-A, Block 5.
