PROBLEM/ISSUE STATEMENT
NorthWestern Energy has requested a utility easement in the Boothill Cemetery. NorthWestern Energy is currently doing directional borings to install conduit in the Right of Way along the 6th Street Bypass to the west and Aronson Avenue to the North of the Cemetery. Due to encountering rock, the directional boring equipment migrated onto Boothill Cemetery land in the northwest corner. They are requesting an easement to cover the encroachment as shown in the exhibit of the attached Utility Right-of-Way easement document (See Attachment #1).
ALTERNATIVES ANALYZED
City Council may:
- Approve the easement; or
- Disapprove the easement.
FINANCIAL IMPACT
There is no financial impact to the park or to the City of Billings. NorthWestern Energy will be paying all costs associated with the installation. Any potential impacts to the Park will be corrected by NWE per the guidelines established in the City of Billings Department of Parks, Recreation and Public Lands Park Easement Policy.
RECOMMENDATION
Staff recommends that the City Council approve the proposed easement.
