PROBLEM/ISSUE STATEMENT

The developer of Annafeld Subdivision has submitted an exempt plat creating a right of way tract along Lot 4 of Annafeld Subdivision 1st Filing.  This right of way tract will make Farmstead Avenue a public street.  Originally, the developer was going to make this street private.  In order to construct the necessary utilities, it became necessary to change the street to public.  The street has been reviewed by the city and was constructed to city standards.  In order to create the right of way tract, it is necessary for the city accept a warranty deed for the tract.  Attached is a copy of the warranty deed and the subdivision plat.

ALTERNATIVES ANALYZED

Council may:

  • Accept the warranty deed creating a right of way tract making Farmstead Avenue a public street; or
  • Do not accept warranty deed creating the right of way tract.  Farmstead Avenue would remain a private street, and a utility easement would need to be completed allowing public utilities within a private street.  

FINANCIAL IMPACT

There is no significant financial impact with acceptance of the warranty deed. 

RECOMMENDATION

Staff recommends Council accept the warranty deed for the right of way tract for Farmstead Avenue.
