Warranty Deed for Right of Way for Georgina Drive

PROBLEM/ISSUE STATEMENT

The developer of COS 2063 has submitted an exempt plat splitting off two road tracts for Georgina Drive. The developer is deeding these tracts to the City which requires the City to accept a warranty deed. The developer will be required to construct Georgina Drive in the future to city standards. Attached is a copy of the exempt plat and the warranty deed. Tract 2A-2 is for the main part of Georgina Drive and Tract 2A-3 is for a small portion where a future roundabout will be constructed. Georgina Drive is part of the Lenhardt Square master plan. The alignment of the streets were master planned but not dedicated to the City until lot development.  

ALTERNATIVES ANALYZED

Council may:

  • Accept the warranty deed for Georgina Drive. Georgina Drive is master planned at this location and is classified as a collector street; or
  • Do not accept the warranty deed. This would require Georgina Drive to be constructed as a private road. 

FINANCIAL IMPACT

There is no significant financial impact with acceptance of the warranty deed. 

RECOMMENDATION

Staff recommends Council accept the warranty deed for the street tract for Georgina Drive.
