PROBLEM/ISSUE STATEMENT
Billings, Montana City Code, Section 13-502, currently authorizes the City Administrator to execute amendments and change orders as long as any increase in contract amount does not exceed:
a. Ten (10) percent of the contract price;
b. Five hundred thousand dollars ($500,000.00); or
c. The original budgeted contingency, whichever is less.
City staff is recommending that the City Administrator also be authorized to approve any amendment or change order that does not exceed his/her signing authority allowed by resolution, which will allow for more consistency and decrease the number of small amendments and change orders that require Council action.
As a separate item, the City Council approved Resolution No. 18-10756 at its September 10 meeting. It encompasses all of the signing authority pertinent information including the City Administrator contract amendment and change order authority language.
The public hearing and first reading occurred at the September 10, 2018, Council meeting.

ALTERNATIVES ANALYZED
City Council may:
- Approve the ordinance and repeal of BMCC 13-502;
- Modify the ordinance and repeal of BMCC 13-502; or,
- Disapprove the repeal of BMCC 13-502.
FINANCIAL IMPACT
Other than time savings, the City will have no financial impact by approving repeal of BMCC 13-502.
RECOMMENDATION
Staff recommends that the City Council approve on second reading this ordinance repealing BMCC 13-502.
