PROBLEM/ISSUE STATEMENT
The City of Billings and Morrison-Maierle (MMI) entered into a Professional Services Contract on November 13, 2017. The original scope of the project was to design and construct a new Fox Pump Station to serve Zone 4 North. This zone is part of the City's water distribution system in the Billings Heights. Amendment 1, approved March 12, 2018, added to the scope of work by providing design of the instrumentation and controls (I&C) and the associated programming and integration.
Late in the design phase, staff requested some changes that are beneficial to the project but also changed and/or added to MMI's scope of work. The biggest change was in the type of construction. It was initially thought a pre-fabricated building with a pre-fabricated pump skid would be sufficient. However, after further investigation and discussion with staff, a normal "block" construction was determined to provide a longer-lasting and lower maintenance option while providing all amenities staff believe are needed in the new facility. This substantially lengthened the construction period, so MMI will have additional time and fees for construction administration and observation. Further details are included in the attached Amendment 2.

ALTERNATIVES ANALYZED
The Council may:
- Approve Amendment No. 2 to the Professional Services Agreement with Morrison-Maierle; or
- Not approve Amendment No. 2 to the Professional Services Agreement, resulting in insufficient construction administration and observation services for the duration of the project.

Amendment 2 increases the contract amount by $65,910. There are sufficient funds in the Water Fund to cover the additional costs, but the contract amount is being increased by more than 10%, so Council approval is required.
RECOMMENDATION
Staff recommends that the City Council authorize the Mayor to execute Amendment No. 2 to the Professional Services Contract with Morrison-Maierle for W.O. 17-16: Fox Pump Station Improvements, in the amount of $65,910.
