PROBLEM/ISSUE STATEMENT
W2K Animal Services, Inc. is required to construct a public sidewalk along the frontage of their property on Conrad Road as part of their site development. In order to avoid removal of the existing trees, the sidewalk would need to be constructed on their property instead of in the right of way. Because a public sidewalk is required, an easement would need to be granted to the city. Attached is the easement allowing the sidewalk to be constructed on their property.
ALTERNATIVES ANALYZED
The Council may:
- Accept the sidewalk easement; or
- Do not accept the sidewalk easement. If an easement does not exist, the property owner would have to remove the trees in order to construct the sidewalk.
FINANCIAL IMPACT
There is no financial impact because the property owner is donating the sidewalk easement.
RECOMMENDATION
Staff recommends that the City Council accept the sidewalk easement from W2K Animal Services, Inc.
