PROBLEM/ISSUE STATEMENT

City election ward boundaries must be adjusted to conform to city limit amendments resulting from annexation of property into the City. The City Council approved the annexation of property owned by McCall Development (Annexation #19-01) on April 22, 2019. The subject property is 45.398 gross acres and described as tracts of land situated in the NW 1/4 of Section 19, T.1S., R.26E., Yellowstone County, Montana, more particularly described as: Tract 2B of Amended Tract 2 Certificate of Survey No. 3594, Recorded March 01, 2019, under Document No. 3876931, on file and of record in the Records of Yellowstone County, (prior to the merging with Lot 1, Block 5 of  Amended Plat of Lot 1, Block 5, Annafeld Subdivision First Filing, Recorded March 01, 2019, under Document No. 3876933); Lot 2B, Block 1 of Amended Plat of Lot 2, Block 1, Adam And Mollie Walter Subdivision, First Filing, Recorded April 18, 2019, under Document No. 3880645, on file and of record in the Records of Yellowstone County, (prior to the merging with Lot 1A, Block 4 of  Amended Plat of Lots 1 and 2, Block 4, Annafeld Subdivision First Filing, Recorded September 14, 2018, under Document No. 3862576), including all adjacent right-of-way of Elysian Road;

This annexation requires a change in the boundaries of Ward III. Two readings are required for this action. The first reading of the ordinance and public hearing was held May 13, 2019. Council approved the ordinance on first reading at that meeting.

ALTERNATIVES ANALYZED

City Council may approve or not approve the ordinance to amend the boundaries of Ward III on second reading.
  • Approving the ordinance will modify the boundaries of Ward III to include the property owned by McCall Development.
  • Not approving the ordinance will not modify the boundaries of Ward III and create a problem where property inside the City Limits is not within one of the City Ward Boundaries.

FINANCIAL IMPACT

There is no budget/financial impact from this action.

RECOMMENDATION

Staff recommends that the City Council approve the second reading, adding recently annexed property to Ward III.
