PROBLEM/ISSUE STATEMENT

The final plat for High Sierra Subdivision, 12th Filing, is being presented to City Council for approval. The subject property is generally located north of Topanga Avenue in the 11th Filing and East of High Sierra Boulevard. The property is zoned Residential 7000 Restricted and will create 66 lots. The representing agent is Sanderson Stewart, agent for High Sierra II, Inc. The preliminary plat received conditional approval from City Council on October 22, 2018. Staff has determined that the proposed plat has met all the conditions of approval and is forwarding a recommendation of final approval to the City Council. Since a portion of this subdivision will remain outside the City in Yellowstone County, the Yellowstone County Board of County Commissioners must also approve of this final plat. For this reason, the attached SIA has signature blocks for both City Council and County Commission and there are two Waivers of Right to Protest future SIDs and RSIDs. Upon City Council and County Commission approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of High Sierra Subdivision, 12th Filing. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in Section 76-3-611, MCA, and Section 23-307, BMCC.

FINANCIAL IMPACT

There is no direct financial effect on the Planning Division Budget with the approval of this final plat. As the newly created lots are developed, the City overall will see small increase in tax and assessment revenues while also an increase in service demands.

RECOMMENDATION

Staff recommends that the City Council approve the final plat of High Sierra Subdivision, 12th Filing.
