PROBLEM/ISSUE STATEMENT

On April 26, 2019, WWC Engineering, agent for Island Mountain Development Group, applied for an amendment to the Legacy Subdivision Improvement Agreement (SIA). Under new ownership, the owners wish to modify some items in the SIA concerning fire access and road construction, and to reduce the number of phases from 3 to 2. An explanation of the requested changes are attached to this staff report. The subject property is generally located south of Grand Avenue and west of 52nd Street West. The property is zoned Residential-9600 (R-96).

ALTERNATIVES ANALYZED

City Council may: Approve of disapprove of the proposed changes to the SIA.

BACKGROUND
Legacy Subdivision was recorded on March 06, 2006. Under new ownership, the owners would like to proceed with the subdivision in a different manner than originally planned.  The changes requested in the SIA include roads and bridges that have either already built or will be built to provide two points of access to the subdivision to meet requirements of subdivision regulations. They would like to modify the phases and re-align their boundaries to match the new planned infrastructure installation. Installation of roads and re-aligning phasing boundaries will allow them to complete the subdivision in two phases rather than three.

See the attached proposed changes to the SIA and the letter from the agent explaining the requested changes.  Also attached is the recorded plat of Legacy Subdivision for reference.  
 
Planning staff requested comment from divisions affected by the proposed changes in the SIA.  There were some comments made and minor changes recommended to the proposed changes in the SIA.  The attached proposed changes are a result of those conversations and additional changes to the SIA.

Staff is recommending approval of the proposed amendments to the SIA for Legacy Subdivision.

FINANCIAL IMPACT

Approval of this subdivision does not have a direct fiscal impact to the Planning Division's budget.

RECOMMENDATION

City staff have reviewed this proposed SIA amendment and are recommending approval of the amended SIA of Legacy Subdivision to the City Council.
