PROBLEM/ISSUE STATEMENT
The developer of High Sierra Subdivision 1st Filing is replatting a portion of High Sierra Subdivision 1st Filing. The developer is proposing to vacate Bonita Circle between Sierra Grande Boulevard and El Rancho Drive. The developer will then re-dedicate an equivalent area further downstream to develop as a storm water pond. The intent of this change is to reduce the effects of stormwater at the intersection of Sierra Grande Boulevard and Morocco Drive. With the plan of re-dedicating an equivalent area, the developer is requesting that the vacation of Bonita Circle be at no cost. This Council action acknowledges the right of way vacation application and sets a public hearing date of August 12, 2019. The developer is proposing multiple exempt plats eliminating the street and re-dedicating an area for stormwater conditioned on approval of vacation of the right of way. Attached is an exhibit showing the proposed vacation along with the new area to be dedicated.
ALTERNATIVES ANALYZED
The Council may:
- Acknowledge receipt of the petition to vacate the above mentioned right of way and set a public hearing for August 12th; or
- Do not acknowledge the petition to vacate the right of way. If not acknowledged, the right of way vacation cannot proceed and new amended plat will not proceed.
FINANCIAL IMPACT
Since the right of way proposed to be vacated has not been constructed and new right of way will be dedicated to replace the vacated area, the developers are requesting there is no cost for the vacation.
RECOMMENDATION
Staff recommends that Council acknowledge receipt of the petition to vacate a portion of Bonita Circle and set a public hearing for August 12, 2019.
