PROBLEM/ISSUE STATEMENT

On July 24, 2019, WWC Engineering, agent for Canal Vista, LLC, applied for Final Minor plat approval for Lake Hills Subdivision, 25th Filing, Amended. The proposed subdivision creates one lot from 32 residential lots. This plat makes it possible for future re-subdivision or a master site plan where single family dwellings can be built. This plat does not create any new roads but will result in one large lot with access points on the south and north ends. A street vacation process was required prior to the filing of this plat and was previously approved by City Council.  The vacation was processed and the documents were recorded with the clerk and recorders office on March 29, 2019. Since the road rights-of-way are now gone, this plat to create one lot will ensure the property has legal and physical access going forward. The subject property is generally located north of the intersection of Ditton Drive and Greenbriar Road in Billings Heights. This proposed single lot is zoned Residential 9600 which only allows single family residential development. City staff has reviewed the application and determined that the proposed plat has met all the conditions of approval and is forwarding a recommendation of approval to the City Council. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder

ALTERNATIVES ANALYZED

The City Council may approve or disapprove the final plat of Lake Hills Subdivision, 25th Filing, Amended. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in Section 76-3-611, MCA, and Section 23-307, BMCC.

FINANCIAL IMPACT

Final plat approval of Lake Hills Subdivision, 25th Filing, Amended has no direct financial impact on the Planning Division.

RECOMMENDATION

City staff recommends the City Council approve the final plat of Lake Hills Subdivision, 25th Filing, Amended.
