Acknowledge Receipt of Petition to Vacate Alleys within Block 81 and 120 Original Town and Set a Public Hearing

PROBLEM/ISSUE STATEMENT

J & S Properties, Inc. has petitioned to vacate the alley within Block 81 of Original Town and the north/south alley within Block 120 of Original Town.  These alleys are located between Montana Avenue and 2nd Avenue North and North 16th Street and North 17th Street.  J & S Properties owns all of the properties abutting these two alleys and there are no public utilities within them.  J & S Properties is attempting to make the property more viable for future development.  Coldwell Banker completed a brokers property evaluation for the alley and have determined the alleys to be valued at $74,790.  The area of the alleys proposed to be vacated is 9,000 square feet.

ALTERNATIVES ANALYZED

The Council may:
  • Approve acknowledgment of petition to vacate the above-mentioned right-of-way and set a public hearing for February 10, 2020.
  • Do not acknowledge the petition and terminate the right-of-way vacation process.  If not approved, future development would need to be designed to accommodate the alley right of way.  

FINANCIAL IMPACT

Coldwell Banker completed a brokers property evaluation for the alleys and determined the value to be $74,790.  This will be the total compensation the property owner would pay to the city for vacation of the alleys.  Administrative Order #56 allows for a comparative sales data instead of a formal appraisal.  

RECOMMENDATION

Staff recommends that Council acknowledge the receipt of petition to vacate the alley within Block 81 of Original Town and the north/south alley within Block 120 of Original Town,  and set a public hearing for February 10, 2020.
