PROBLEM/ISSUE STATEMENT

W.O. 19-22 King Avenue East Improvements Project is planned to construct water, storm and street improvements between Orchard Lane and Jackson Street.  The project will include the installation of street lights within the project area.  Passage of this Resolution of Intent is the first step in the legal process of creating a lighting maintenance district to pay the costs of operating and maintaining the new lighting. Passage of this Resolution of Intent will trigger the mailing of legal notices to the affected property owners and set a public hearing at the March 23, 2020, City Council meeting.

The new lighting will use LED lamps and underground wiring.  The cost of installing the new lighting will be paid for with project funds.  The adjacent property owners will only pay for electrical energy and maintenance, through an assessment on their property tax statements.  Light district assessments will range from approximately $25.99 to $1,188.48 per year depending on the area of the property within the District boundary.

The properties on Cambridge Drive will not be assessed in this District as they are already being assessed in existing light districts.

ALTERNATIVES ANALYZED

City Council may:
  • Pass the Resolution of Intent to create SILMD 326 to provide a source of funding for operation and maintenance of the streetlights and set a public hearing for March 23, 2020; or
  • Do not pass the Resolution of Intent or set a public hearing date. If the Council does not adopt the Resolution, the property owners cannot be assessed for operation and maintenance of the streetlights, so the new lighting will not be installed.

FINANCIAL IMPACT

All costs of maintaining and providing energy for the lighting are paid from assessments against the properties within the light district.  There are no City owned properties within the district.

RECOMMENDATION

Staff recommends the City Council approve a resolution of intent to create SILMD 326 and set a public hearing for March 23, 2020.
