PROBLEM/ISSUE STATEMENT
The developer of Grand Peaks Subdivision, 5th Filing, is required to construct a right turn lane entering the subdivision from Grand Avenue. In order to construct the turn lane, it is necessary to obtain a small easement from the adjacent property owner, Judith (Judy) Deines. The developer has negotiated the easement with Ms. Deines. The total area of the easement is 406 square feet. There is no cost to the City for the easement or the construction of the turn lane.
ALTERNATIVES ANALYZED
The City Council may:
- Approve the easement; or
- Do not approve the easement. This would make construction of the turn lane difficult as there is not enough right-of-way in this area to construct the turn lane.
FINANCIAL IMPACT
There is no cost to the City in acceptance of the easement.
RECOMMENDATION
Staff recommends that Council accept the perpetual public road easement from Judy Deines.
