INTRODUCTION
On January 2, 2020, Northern Engineering and Consulting Inc., agent for Felton Associates, Inc., applied for preliminary major plat approval for Emma Jean Heights Subdivision, 4th Filing. The proposed subdivision creates 43 lots for single-family residential development. This proposal is the fourth filing of a master planned subdivision that was originally reviewed in 2006. The subject property is generally located on the west side of Bitterroot Drive, south of Wicks Lane in northeast Billings Heights. The property is zoned Residential-7000 (R-70).
RECOMMENDATION
Staff recommends that the Planning Board recommend conditional approval of the preliminary plat of Emma Jean Heights Subdivision, 4th Filing to the City Council, and adopt the Findings of Fact as presented in the staff report.
PROPOSED CONDITIONS OF APPROVAL
Pursuant to Section 76-3-608(4), MCA, the following conditions are recommended to reasonably minimize potential adverse impacts identified within the Findings of Fact.
1. To minimize the effects on local service, prior to final plat approval, the applicant will coordinate with the USPS for locating and providing the correct amount of space for safely delivering the mail to the residents. 2. Minor changes may be made in the SIA and final documents, as requested by the Planning, Legal or Public Works Departments to clarify the documents and bring them into the standard acceptable format. 3. The final plat shall comply with all requirements of the City of Billings Subdivision Regulations, rules, regulations, policies, and resolutions of the City of Billings, and the laws and Administrative Rules of the State of Montana.
PLAT REVIEW DISCUSSION / STAKE HOLDERS
Planning staff gave a brief presentation about the proposed subdivision and stood for questions. There was one question from the board about existing detention ponds on private lots within the subdivision. Staff responded that they are there until the city has a storm drain system in place to take storm water from the subdivision. After there is a storm water system from the city in place the lots with the detention will no longer need to be needed and can be filled and sold for home construction.
Planning board president Woody Woods asked if the agent or applicant wished to address the board. Mr. Charles Felton addressed the board stating the storm water system is scheduled to be installed in Bitterroot Drive in 2024. Mr. Felton was asked if he will be building the trail along the BBWA Canal. He stated that he would build it along the BBWA Canal through this filing as he has with previous filings. The trail is 20 feet wide and is dedicated to the parks department, maintenance will be done by the parks department although Mr. Felton has been doing up to this point in time.
