PROBLEM/ISSUE STATEMENT
The developer of Western Sky Subdivision 2nd Filing, is constructing a storm drain outfall to the Hogan Slough. In order to meet the requirements for water quality, they are constructing a mechanical device that will clean the storm water prior to outfalling. The subdivision will be required to maintain the mechanical device. If they fail to maintain the mechanical device, the City reserves the right to maintain it and assess the subdivision. In order to access the device, the developer is required to give the City an easement. The easement will allow the City to enter the property if needed.
ALTERNATIVES ANALYZED
The City Council may:
- Approve the easement; or
- Do not approve the easement. If the developer fails to maintain the water quality mechanical device, the City would not be able to access the device to correct the issue if the easement is not in place.
FINANCIAL IMPACT
There is no cost to the City for acceptance of the easement.
RECOMMENDATION
Staff recommends that Council accept the storm drain easement from Mont Vista, LLC.
